Orion Energy Systems has settled it lawsuit with a former employee. Orion will pay the employee $100,000 because she alleged the company fired her for not taking part in the company wellness program. The U.S. Equal Employment Opportunity Commission brought the suit against Orion, and claimed their wellness program illegally required medical examinations. When Wend Schobert declined to participate, Orion made her pay the entire premium for her employee health benefits, and was fired not long after. Besides the payment, Orion also agreed to not maintain any wellness program that poses and disability related inquiries, or seeks a medical examination that is non-voluntary.
