Circuit Judge Jeffrey Conen has rejected a defense request for a mistrial, after emotional outbursts at the trial of former Milwaukee police officer Dominique Heaggan Brown. On the opening day of testimony, jurors saw a never released video from another officer’s body camera, which showed the chase from last August in which Heaggan Brown shot and killed Sylville Smith — prompting two nights of violence. The video was first shown at full speed, causing some of the victim’s relatives to gasp and leave the courtroom — and that prompted defense lawyer Steven Kohn to seek a mistrial. Judge Conen rejected it, but told jurors to ignore the gallery’s reactions to the video. In slow motion, it showed Smith being shot twice — and an officer finding Smith’s gun between the two shots.
