A conservative legal group is suing the state’s education agency, saying it’s not following a new law requiring its agency rules to be submitted to the Walker administration for approval. The Wisconsin Institute for Law and Liberty says the Department of Public Instruction is no different than other agencies who need to follow the REINS Act that majority Republicans approved a few weeks ago. The plaintiffs says the D-P-I bypassed Walker and his people in adopting program for mental health, early college credit, and open enrollment. The suit indicates that state Superintendent Tony Evers believes his agency is exempt from the REINS Act because of a 2016 State Supreme Court decision. It said the voters are the superintendent’s bosses because unlike other agency heads, that person is elected every four years.
