The attorney for convicted killer Steven Avery is asking the court to throw out his conviction and order a new trial. Avery and his nephew are in prison for the 2005 murder of freelance photographer Teresa Halbach. Attorney Kathleen Zellner says fraud was perpetrated on the jury in Avery’s trial 12 years ago. She argues that remains found at a Manitowoc County gravel pit belonged to Halbach, which would have brought the prosecution’s narrative into question. The motion filed Monday also calls for Sheboygan County Branch 3 Judge Angela Sutkiewicz to recuse herself.
