Manitowoc County Circuit Judge Jerilyn Dietz heard testimony yesterday from the team representing 16 year old Damian Hauschultz and the prosecution, regarding whether or not the teen should be tried as an adult for Reckless Homicide.
Hauschultz was arrested last April after 7 year old Ethan Hauschultz died due to the alleged brutal punishment enforced by Damian. Reports indicate that the younger Hauschultz boy was forced to carry a 44 pound log around a muddy path, and was buried beneath 80 pounds of snow.
The defense claims that Damian didn’t realize the potential consequences of the punishment, because he had been forced to endure it prior at the hands of his adoptive father, Timothy Hauschultz.
Judge Dietz is scheduled to give her ruling on January 9th.
