A Milwaukee County judge has thrown out a hate crime enhancer in the case against a woman who spat on a Black teenager.
The incident happened in Shorewood last year.
Stephanie Rapkin is still charged with disorderly conduct.
Those charges were filed against the 65-year-old Shorewood woman after a video showed her spitting on Eric Lucas.
He had confronted the woman after she blocked protesters with her car.
She also faces a felony charge for her actions when she was taken into custody by a police officer the next day.
