Madison’s city clerk says the Wisconsin Senate’s subpoena puts her in a bad spot.
Maribeth Witzel-Behl says it gives her the choice of risking federal prosecution for violating election laws – or defying the state senate and possibly ending up in the Dane County Jail.
Witzel-Behl described her predicament in a letter to the Legislative Audit Bureau.
The Legislature is demanding her office hand over its records from the November presidential election.
In her letter, Witzel-Behl points to federal election rules that mandate all records be retained and preserved for 22 months after the election.
Mayor Satya Rhodes-Conway has said the Bureau can have access to the information requested inside the clerk’s office.
