21-year-old Joshua Walcott says he was in and out during the night Malachi Moore was shot.
That’s because he said had taken Xanax and only remembered seeing Moore hit the floor.
That was his testimony as he took the stand in his defense today.
Walcott is accused of shooting and killing Moore in Two Rivers in May 2021.
During questioning from Defense Attorney Matt Last, Walcott says he and Malachi were close and didn’t get into arguments.
The night of the shooting he says he remembers going to get food for Malachi after taking Xanax and coming back.
He also said he did remember seeing several people at the home on 28th Street in TR where the shooting happened.
He says after Moore hit the floor, he started tending to him and asked someone to call 911.
After that he said that he and another person named Rodney Anderson left the house through a window.
Walcott would later say that it was Rodney who told him that he shot Malachi.
He said he later told police he guessed he shot Malachi, but he was in and out all night so nothing was clear.
During cross-testimony, Manitowoc County District Attorney Jackie Lebre asked about his past alcohol use and how Xanax affected his judgment.
She also asked about the relationships between Walcott and two women who live at the home.
Last says Walcott will be his only witness called today. Lebre says there might be some witnesses she might call back on the stand.
