Steven Avery has filed an appeal in a new evidentiary hearing that was denied by a Sheboygan County judge last year.
He is asking an appeals court to deny postconviction relief and grant the evidentiary hearing because of new evidence she says she’s found.
The 57-page appeal, filed by Attorney Kathleen Zellner, is claiming the argument that a suspect she believes committed the 2005 murder of photographer Teresa Halbach had possession of her vehicle and that the judge didn’t apply standards properly when evaluating if a suspect would be allowed to blame another party for the crime.
No hearings have been scheduled yet for the appeal.
