21-year-old Gabriel T. Whatley, of Two Rivers, was found guilty of Throwing or Discharging Bodily Fluid at Public Safety Worker or Prosecutor.
This case stems from a September 16th 2022 incident when Manitowoc Police noticed a vehicle the suspect was driving displayed no registration plates.
When pulled over, Whatley was reported to be uncooperative, refusing to identify himself.
He showed signs of impairment, placed into handcuffs, and put into a squad car to be taken to a local hospital for a blood draw.
Whatley refused and kicked the back seat of the squad car and spit on the windows.
At one point, he also allegedly threatened to beat the officers up.
Judge Jerilyn Dietz sentenced Whatley to the Wisconsin State Prison System for a total sentence of 2 years.
That’s 1-year initial confinement followed by 1-year extended supervision.
Execution of the sentence is stayed, and the defendant is placed on probation to DOC for 2 years.
Some of the conditions of probation are Assessment, treatment, counseling as deemed appropriate, Pay $1,573.20 restitution to Cities and Villages Mutual Insurance, Maintaining absolute sobriety with the exception of any prescription medications, Maintaining fulltime employment, schooling, work search or combination, and Spend six (6) months in the county jail, under the Huber Law.
