A 49-year-old man is not allowed to drive any motorized vehicle, one of two conditions of bail set by the court Monday following his arrest on operating while intoxicated-Seventh Offense early Sunday morning.
Ricardo Gaytan also must maintain “absolute sobriety.”
Additional charges filed include one count of Threats to Law Enforcement and two counts each of discharging bodily fluid at Law Enforcement and Misdemeanor Bail Jumping.
Police saw a vehicle driven by Gaytan swerving in the downtown area and conducted a traffic stop.
A smell of intoxicants emitted from his vehicle, and after it was determined that Gaytan was under the influence, a field sobriety test was ordered, which he refused to take.
He allegedly spit at and verbally abused officers when his rights were read to him.
Police add that Gaytan was able to remove a spit mask placed over his mouth, attempting a second time to spit at officers.
He also allegedly threatened to kill an officer while he was filling out paperwork at a local hospital.
Gaytan remains in The County Jail in lieu of $8,000 cash bail, and his initial appearance is scheduled for May 6th at 1:30 p.m.
