The family of a man who was shot and killed by police in Appleton has filed a lawsuit against the City and the Police Officer who pulled the trigger.
As we reported in August of 2022 after a neighbor sent us a video of the situation, 33-year-old Daniel Pesavento was shot in his driveway while he appeared to be going through a mental health crisis, as he was rocking back and forth while wielding a handgun.
WBAY TV reports that the lawsuit claims that Pesavento never took any threatening stance toward Office Bryce Rudebeck, the officer who shot him, which we also noted in our description of the video.
The lawsuit claims that the use of deadly force was “unnecessary, unreasonable and excessive.”
The family has requested a jury trial, however, no federal court date has been set.
