
A new person is presiding over a lawsuit filed against the City of Sheboygan.
Circuit Court records show that Judge George Limbeck has taken over the case that has been filed against the city and its Plan Commission.
On the request of the city, Limbeck will be replacing Judge Rebecca Persick who had been overseeing proceedings since the lawsuit was filed in late January.
Eight residents living in the Black River area of Sheboygan have filed the lawsuit in response to a proposed Kohler golf course and the Plan Commission’s handling of a conditional use permit (CUP)issued to Kohler and extended nearly three years later.
In the lawsuit, the residents claim various forms of wrongdoing by the city including going against its own municipal code, conflict of interests, and ignoring a decision by the Wisconsin Court of Appeals amongst others.
The Sheboygan residents’ argument revolves heavily around a November 12th Plan Commission meeting where an extension was given to Kohler for their CUP for land on the shores of Lake Michigan where the proposed golf course would be built.
This extension came over 1,000 days after the City’s own requirements that state, “The start of construction of any and all conditional uses shall be initiated within 365 days of their approval by plan commission.”
At this time, no future court date has been set in the case.
