
An appeal in the case of the great-uncle charged in the 2018 death of Ethan Hauschultz has been denied.
The 2nd District Wisconsin Court of Appeals announced the decision yesterday saying, “We conclude there are no sufficiently compelling reasons to warrant interlocutory review in the case.”
The court’s opinion continues by saying they aren’t convinced that 54-year-old Timonthy Hauschultz has shown a substantial likelihood of success in their appeals because he can’t just claim bias because a plea deal was rejected.
The appeal was filed by defense attorneys after Manitowoc County Judge Jerilyn Dietz didn’t accept the deal that would have had Timothy plead guilty to two counts of child abuse.
The defense attorneys asked Dietz to recuse herself claiming bias in the case, which she also denied.
The denial means Dietz will still preside over the case and Timothy will return to court on September 4th.
He faces charges including felony murder and contributing to a death after Ethan died from being poked and hit over 100 times while carrying a heavy log in the snow.
Damian Hauschultz is serving a 20-year prison sentence for Ethan’s death, but prosecutors claim Timothy ordered the punishment to happen because the two didn’t learn Bible verses.
