Wisconsin’s governor, attorney general, and Department of Justice are suing the Legislature’s Joint Finance Committee.
The suit filed Tuesday asks that an injunction be placed on a 2018 law that gives legislators significant oversight of Attorney General Josh Kaul.
Their lawyers argue the bill violates the separation of powers in the Wisconsin Constitution.
Under Act 369 – the law being challenged – Kaul is precluded from compromising or discontinuing civil suits without the approval of the committee.
The Wisconsin attorney general’s office had discretion over settling those cases in the past.
