Tammy M. Kirchen, 53, Manitowoc, possession of Methamphetamine and Misdemeanor possess drug paraphernalia on 6/8/21, Guilty due to no contest plea, on count 1, sentence is withheld and the defendant is placed on probation to DOC for eighteen (18) months. Conditions of probation: 1) Pay court costs; 2) pay supervision fees in an amount to be determined by DOC; 3) Provide DNA sample; 4) Maintain fulltime employment, schooling, work search or combination; 5) Assessment, treatment, counseling as deemed appropriate by the Department’s assessment process; 6) AODA assessment and follow through; 7) maintain absolute sobriety; 8) Submit to random urine screens and pay for same. Swetlik, 40, Manitowoc, 2nd degree sexual assault of a child, possession of child pornography (2-counts) on 7/24/21, Guilty due to no contest plea, on count 1, the defendant is sentenced to the Wisconsin State Prison System for a total of twenty-two (22) years. That is twelve (12) years initial confinement followed by ten (10) years extended supervision. On counts 2 and 3, the defendant is sentenced to the Wisconsin State Prison System for a total of thirteen (13) years. That is three (3) years initial confinement followed by ten (10) years extended supervision, on each count, concurrent and concurrent with the sentence imposed on count 1. The defendant is not eligible for the Challenge Incarceration Program or the Substance Abuse Program. Defendant has credit for 390 days. Conditions of extended supervision; 1) Assessment, treatment, counseling as deemed appropriate by the Department’s assessment process; 2) AODA assessment and follow through; 3) Undergo psycho/sexual assessment and follow through; 4) Undergo mental health assessment and follow through; 5) Have no contact with the victim; 6) Have no contact with anyone under the age of 18, including his own children, unless permitted by the agent and the Department of Human Services; 7) Comply with the Sex Offender Registry; 8) Pay court costs, plus the $500.00 pornography surcharge of counts 2 and 3 for two images. Total costs are $2,228.00. Court orders that any waivable costs/surcharges be waived at this time, any remaining costs/surcharge will need to be paid during the term of extended supervision. (Per statutes, none of the costs assessed in this case are waivable); 9) pay supervision fees in an amount to be determined by DOC.

Defendant’s operating privilege is revoked for six (6) months.

Conditions of probation are: 1) Assessment/ treatment/ counseling as deemed appropriate by the Department’s assessment process; 2) AODA assessment and follow through; 3) Maintain absolute sobriety; 4) Submit to random urine screens and pay for same; 5) Contact with her children at the discretion of the agent or CPS; 6) Fifteen (15) days jail imposed and stayed, to be imposed upon the discretion of the agent and upon order of the court; 7) Pay costs of action; 8) Pay supervision fees in an amount to be determined by DOC; 9) Submit DNA sample and pay surcharge; 10) Maintain full-time employment/ schooling combination.
