A Manitowoc native attending the Naval Academy may be going to court soon.
Garrett Lee Holsen was accepted into the academy in 2020, and last year, he was accused of sexually assaulting a fellow midshipman during an off-campus party.
The Baltimore Sun reports that Holsen was acquitted just over a year ago, but the prosecution is appealing that decision.
Appellate Court of Maryland Judge Douglas Nazarian did not make a firm decision on whether Holsen’s case would be reopened, but if it does, the lawyer who represented him the first time around, Peter O’Neill, said that he would come back to help Holsen a second time.
Several witnesses testified during a trial last year that Holsen had intercourse with the heavily intoxicated woman, but O’Neill argued the woman was not intoxicated and that the encounter was consensual.
