The City of Appleton and the police officer who shot and killed a man nearly two years ago claim there was no wrongdoing.
Officer Bryce Rudebeck was dispatched to a residence on North Birchwood Avenue on August 12th, 2022, alongside Office Tony Shuman, where they found Daniel Pesavento in the driveway with a handgun.
Several times, Pesavento pointed the gun at himself. The officers attempted to talk him down, but Rudebeck eventually shot and killed Pesavento.
Shuman also fired his weapon, but his round was said to have missed.
Pesavento’s family has since filed a wrongful death lawsuit, and on Tuesday, the City of Appleton responded.
FOX11 reports that the city denied any wrongdoing, saying that the “actions attributed to Defendant Rudebeck were taken in the course and scope of that employment.”
They also asked for the case to be dismissed.
A scheduling conference is set for August 29th in the federal case.
