A Manitowoc man charged with robbing a gas station earlier this year is not ready to stand trial.
According to court records, Manitowoc County Judge Mark Roher found that 32-year-old Justin Smith is incompetent to proceed with his court case.
Smith will be committed to the Wisconsin Department of Health and Human Services to try and receive treatment. Roher didn’t decide on whether Smith should be given medication if needed.
According to a criminal complaint, Manitowoc Police were called to the BP Gas Station on Calumet Avenue in May on a report of a robbery.
The suspect fled, but police were able to use K9s and drones to help find Smith.
He was later found in Green Bay and arrested by the US Marshals Service, Great Lakes Regional Task Force. Smith’s bond remains at $30,000 cash.
He was also charged with another felony for throwing or expelling a bodily substance before last week’s ruling.
