Dylan John Swoboda, 22, Manitowoc, manufacture/ deliver schedule I, II narcotics (2-counts), manufacture/ deliver heroin, Guilty due to no contest plea, Defendant is sentenced to the Wisconsin State Prison System for a total sentence of fifteen (15) years, seven and one-half (7 1/2) years initial confinement, followed by seven and one-half ( 7 1/2) years extended supervision. Execution of sentence is stayed and defendant is placed on probation to DOC for eight (8) years. Court finds the defendant is eligible for the Challenge Incarceration Program and for the Substance Abuse Program. Defendant is given credit for 267 days already served. The court will not grant the defense counsel’s request for expungement.

Defendant is placed on probation to DOC for two (2) years. Defendant is placed on probation to DOC for three (3) years. Count 2 – Sentence is withheld. Defendant is placed on probation to DOC for three (3) years. Defendant has 110 days sentence credit. Defense counsel has made a request for expungement on count 1. Court will find that if defendant successfully completes probation and did so without serving any of the jail time and did so without further arrests grant expungement on count 1. Court will also approve out of state travel for a funeral as long as she is with her mother.
